1. WHO IS REQUIRED TO REGISTER?

Sex offenders are required to register.

2. WHAT DOES “SEX OFFENDER” MEAN?

“Sex offender” means any person:
(1) convicted in Utah of a sex offense;
(2) convicted by any other state or the U.S. government of an offense that, if committed in Utah, would be punishable as a sex offense and who is:
(a) a Utah resident; or
(b) not a Utah resident but is in Utah for a period that exceeds 14 consecutive days, or for a total period that exceeds 30 days during any year; or
(3) is found not guilty by reason of insanity of a sex offense.
(Utah Code Ann. § 77-27-21.5 (1)(e))

3. WHAT DOES “SEX OFFENSE” MEAN?

“Sex offense” means:
(1) a felony of Class A misdemeanor violation of enticing a minor over the Internet;
(2) kidnapping a minor;
(3) a felony violation of unlawful sexual activity with a minor;
(4) sexual abuse of a minor;
(5) unlawful sexual conduct with a 16 or 17 year old;
(6) rape;
(7) rape of a minor;
(8) object rape;
(9) object rape of a minor;
(10) a felony violation of forcible sodomy;
(11) sodomy on a minor;
(12) forcible sexual abuse;
(13) sexual abuse of a minor;
(14) aggravated sexual abuse of a minor;
(15) aggravated sexual assault;
(16) sexual exploitation of a minor;
(17) incest;
(18) lewdness involving a minor;
(19) aggravated exploitation of prostitution; or
(20) attempting, soliciting, or conspiring to commit a felony violation of an offense listed in (1) through (19) above.

4. ARE JUVENILE OFFENDERS REQUIRED TO REGISTER?

Please contact the Department of Corrections or local law enforcement for information on juvenile sex offenders.

5. WHEN AND WHERE DOES AN OFFENDER REGISTER?

A sex offender in the custody of the Department of Corrections must be registered by agents of the department upon:
(1) being placed on probation;
(2) commitment to a correctional facility operated by or under contract to the department;
(3) release from confinement to parole status, termination or expiration of the offender’s sentence, or escape;
(4) entrance into and release from any community-based residential program operated by or under contract to the department; or
(5) termination of probation or parole.
(Utah Code Ann. § 77-27-21.5(5))
A sex offender who is not in the custody of the Department of Corrections and who is confined in a correctional facility not operated by or under contract to the department must be registered with the department by the sheriff of the county in which he or she is confined upon:
(1) commitment to the correctional facility; and
(2) release from confinement.
(Utah Code Ann. § 77-27-21.5(6))
A sex offender committed to a state mental hospital must be registered with the Department of Corrections by the hospital both upon admission and discharge.
(Utah Code Ann. § 77-27-21.5(7))

6. WHAT INFORMATION MUST AN OFFENDER PROVIDE AT THE TIME OF REGISTRATION?

Upon registration, a sex offender must provide the Department of Corrections with his or her:
(1) name and all aliases he or she is or has been known by;
(2) residential address;
(3) physical description, including:
(a) age;
(b) height and weight; and
(c) hair and eye color;
(4) vehicle(s);
(5) current photograph; and
(6) each institution of higher education in Utah at which he or she is employed, carries on a vocation, or is a student, and any change in his or her enrollment or employment status at any institution of higher education.

7. WHAT HAPPENS IF AN OFFENDER CHANGES HIS OR HER ADDRESS OR OTHER REGISTRATION INFORMATION DURING THE REGISTRATION PERIOD?

A sex offender is required to register within 10 days of every change of residence.
(Utah Code Ann. § 77-27-21.5(9))

8. IS AN OFFENDER WHO MOVES FROM ANOTHER STATE TO UTAH REQUIRED TO REGISTER?

A sex offender convicted by any other state or by the U.S. government must register with the Department of Corrections within 10 days after entering Utah.
(Utah Code Ann. § 77-27-21.5(8))

9. IS REGISTRATION A LIFETIME REQUIREMENT?

A sex offender must register for the length of his or her sentence and for an additional 10 years after the sentence terminates; however, a sex offender convicted of one of the following offenses must register for life:
(1) a sex offense, if the offender has previously been convicted of a sex offense;
(2) rape of a minor;
(3) object rape of a minor;
(4) forcible sodomy;
(5) sodomy on a minor; and
(6) aggravated sexual assault.
(Utah Code Ann. §§ 77-27-21.5(9)(a)-(b))

10. ARE THERE ANY PENALTIES FOR FAILING TO REGISTER OR FOR PROVIDING FALSE INFORMATION?

A sex offender who knowingly fails to register is guilty of a Class A misdemeanor and will be sentenced to serve a term of imprisonment for no less than 90 days and at least one year of probation.
(Utah Code Ann. § 77-27-21.5(13)(a))

11. WHAT INFORMATION IS RELEASED TO THE PUBLIC ABOUT REGISTERED OFFENDERS?

Information collected upon registration is public record.
(Utah Code Ann. § 77-27-21.5(14))
The Department of Corrections must make the following information public:
(1) the sex offender’s:
(a) name and all aliases he or she is or has been known by;
(b) residential address;
(c) physical description, including:
(i) age;
(ii) height and weight; and
(iii) hair and eye color;
(d) vehicle(s);
(e) current photograph; and
(f) each institution of higher education in Utah at which he or she is employed, carries on a vocation, or is a student, and any change in his or her enrollment or employment status at any institution of higher education;
(2) offense(s) for which the sex offender was convicted; and
(3) a description of the sex offender’s primary and secondary targets.
(Utah Code Ann. §§ 77-27-21.5(11)-(12))

12. CAN I SEARCH THE INTERNET FOR OFFENDERS IN MY AREA?

The Department of Corrections maintains the official online state sex-offender registry. The registry is available at http://corrections.utah.gov/community/sexoffenders/.
The web site can be searched by name and zip code.
Information available includes:
(1) the sex offender’s:
(a) name and all aliases he or she is or has been known by;
(b) residential address;
(c) physical description, including:
(i) age;
(ii) height and weight; and
(iii) hair and eye color;
(d) vehicle(s);
(e) current photograph; and
(f) each institution of higher education in Utah at which he or she is employed, carries on a vocation, or is a student, and any change in his or her enrollment or employment status at any institution of higher education;
(2) offense(s) for which the sex offender was convicted; and
(3) a description of the sex offender’s primary and secondary targets.

13. WHAT IS THE PENALTY FOR MISUSE OF OFFENDER INFORMATION?

Members of the public are not allowed to publicize information obtained from the Internet or use it to harass or threaten sex offenders or members of their families. Harassment, stalking, or threats against sex offenders or their families are prohibited and doing so may violate Utah criminal laws.
