A person with no prior convictions commits a sex offense should he be labeled a predator after his first ever conviction? Should he have a hearing or should it be determined by the crime he commits? Just wondering what everyones thoughts on this are.

I think it should depend on the offense. Despite what certain people feel I don't personally feel my case should ever be listed as predator. Predator to me implies a pedo or serial rapist, some guy who gets caught masturbating to kiddie pics in prison and the like. A first timer? That's only if he had multiple victims or it stemmed over a long period of time.

mislabeling and misuse of labeling

Unfortunely, some people are labeled as a sexual predator when they shouldn't be. This takes away the effectiveness of the label. My son was labeled a sexual predator, and he didn't touch anyone. The victim is suppose to be the State of Ohio. Some of the facts used to assign this label was false statements from the prosecutor. In Ohio, reliable hearsay is allowable, even if it is lies or inaccuracies. Reliable meaning anything a judge wants to use to make them a predator. The predator label can never be removed except from a court of appeals.

Sad to say heresay seems to be allowed everywhere. If you missed the recent posts between me and DP1, you'd see also that the label is varied in meaning depending on the person judging you. Apparently the state of Ohio saw me as a sexually oriented only, but the person deciding that was the Sheriff's Office, not some judge. Again, point of views vary.

Latin praedtor, or "pillager", from praedr, or "to plunder"

The above seems to define a wanton, random, thoughtless and "opportunistic" behavior. The serial rapist who wanders the city looking for the next victim to satisfy his animal urges. The serial child molester who has spent years obtaining and then betraying the trust of pre-puscent children.
As such, the first-time offender with no other known victims in most cases would not be a "predator". Granted, a person who rapes a 2 year-old is certainly worse than an exhibitionist. But we have no need for "labels" for such people if we do the right thing and sentence them to life without parole. Putting them on the street with a "predator" label is nuts.
Ditto two-time losers.

There is nothing "predatory" about possessing child pornography, no matter the content. Doing something with that pornography to lure children into the home and out of their clothing can be seen as predatory.
IMHO

I don't think anyone should be called a predator, but I am sure that it could fit on more than just pedophiles who molest children or child rapists. There are people that go around and prey on indiduals that they end up murdering, there are people who prey on people that they will rob next. You could use the word predator on anybody or anyone or any type of person.

Society thinks that all pedophiles are predators because they think that a man lurks in the shadows for an unaspected child and will rape them and kill them. I most likely could of been called a sexual predator when I regularly molested children before I got caught with my niece. That was a different life than I have now, but I am sure to some in society I will be a child molester/sexual predator forever.

A word like "predator" has no place in civillised jurisprudence. It is emotive and nonsensical.
