Thread (Discussion): I need to know if I can charge him with anything. Please help.

What can I do legally?

I'm helping a friend charge a man with what I believe is sexual assalt, but was almost rape. Here's what happened....
She was with her boyfriend, and his good friend at her house. She was also friends with his friend, because she has been with her boyfriend for several years and his friend has come over a lot. They also knew each other from high school. All of them are 21 years old.
She went to bed and her boyfriend and his friend stayed up for a while. She woke up with her boyfriends friend on top of her. She sleeps naked, so he was touching her everywhere, kissing her, and trying to guide his penis into her vagina. Luckily, she woke up before he got it in and she tried to push him off. She heard the front door open and close, and the guy jumped off of her and she heard him zip up his pants. A second later her boyfriend was pounding on the locked door demanding that his friend open it. He did, and said that he had just gone into her room to ask her for his ciggarettes.

So, he didn't rape her...although he almost did, and he would have if it would have been a few seconds more. He needs to pay for what he did. It's hard for her to even talk about it, much less do something legally about it because he was her friend, and her boyfriends friend.

Does anyone know what she can charge him with. Sexual assault? Intent to rape? I want him to pay for this so that he can't do it to anyone else.

If you'll PM me with a state, I'll lend what advice I can on the matter. Something definitely needs to be done before the guy does something worse.

It could certainly be attempted sexual assault. A couple questions for you.

1) What exactly did the boyfriend do when he got into the room? This guy said he was asking for cigarettes. Did he buy it?

2) Has this guy had any other "incidents" like this in his past that your aware of?

3) Had he made any previous comments to this girl that would imply he was attracted to her?

4) Has she contacted the police yet? If not she really needs to make a report. The longer she waits the more difficult it will be (how long ago was this??).

If you post the state it happened in we can give you better advice including looking up statutes and such.

Hello and welcome to the board. Your friend is lucky to have a friend like you who is obviously concerned.

Please ask your friend to report the crime to the police. Your friend can't charge anybody with anything. Only law enforcement can. There's no need second guessing what the charge might be. Report the crime immediately to the proper authorities.

it is consider assault in my state where i live if you just touch a person without their consent, legal charges can be brought up against the other person, and by the way your boy friend should take his associate's to the nearest motel or hotel sometime's being to nice will get you hurt remember the song about the lady and the snake she open her door and got the snake out of the snow he was all most dead and then she put him in front of her fire place to warm- up and when he did, he bit her and then she reminded him of what she had done for him , and then he reminded her that you knew i was a snake before you brought in your house.

In the state of Wa, rape is defined as : any penetration no matter how slight. But as DP stated, the decision to charge isn't the victims it is up to the State, the decision to 'report' however is the victims.
