It could certainly be attempted sexual assault. A couple questions for you.
1) What exactly did the boyfriend do when he got into the room? This guy said he was asking for cigarettes. Did he buy it?
2) Has this guy had any other "incidents" like this in his past that your aware of?
3) Had he made any previous comments to this girl that would imply he was attracted to her?
4) Has she contacted the police yet? If not she really needs to make a report. The longer she waits the more difficult it will be (how long ago was this??).
If you post the state it happened in we can give you better advice including looking up statutes and such.
