if a girl is 17 and a guy was 20 and she took this to court. would anything happen? like would he be sent to jail? knowning the fact that she has asked him wheather it was illegal or not to have sex and he states that no court can convict him. and the only evidence would be that they both were positive for stds or something like that. and he threatends her saying hes going to harm her because someone vandilized his car. assuming it is her, when really it wasnt at all....???? he knew she liked him and took advantage of the situation and got her pregnate but she had and abortion. he started dating her b/c she was pregnate and he wanted her to get ride of it and he tried everything for her to agree to have an abortion he would touch her sexually and kiss her unwillingly too seduce her to get her to get ride of it. would he be charged???

First thing, you have to know what your state's laws are regarding the age of consent.
Second, was the sex cooerced or forced?

Hello and welcome to this forum. I am sure you'll receive a lot of helpful hints and support from the various posters here. The most important thing to remember in my opinion is that if you believe a crime has occured then call the law and tell them the facts. Let the folks that make the big bucks decide if it's a prosecutable case. The phone call to your local police or prosecuting attorney's office is free and they are there to protect you.

If the age of consent in your state is 18 years, yes.
like would he be sent to jail?

In most states, transmitting and STD via stautory rape is a consideration for sentancing, so, yes it would matter.

If someone threatens you, it's illegal and potentially dangerous for you. I'd recomend that you go, in person, to a police station TODAY and explain to them exactly what took (or is taking) place. They will be able to explain to you the options you have to protect yourself or persue charges against the person in question. At the very least you should go on record with them about his threatening behaviour so there is evidence of it should it happen again.

You kind of jump around from age of consent to force to consensual to something about a car to std's. Can you describe the situation so we can get an idea of what happend?

First there is the age of consent in your state , most are within 3 years and its ok as long as both parties agreed to the sex , but the thing is both had std's ? im not sure what you mean both had std's did one have it and give it to the other ? In some states if you knowingly have an std and infect an unknowing person you can be charged with a crime , I believe in california and some other states if you infect someone with the hiv virus its criminal , im not sure what the law was called as its been a while since I heard about it. More importantly if you have an std you need to go to a clinic immediately !! If you are not treated for infectious diseases it will spread and leave you open to catching other diseases very easily . By the way hiv still leads to aids and aids still leads to death regardless of the medications available , there are many free clinics available to you in most states . PLEASE do not have sex protected or not with anyone while you are infected . Silence = Death

He would most definately be charged with statatory rape! He had sex with a minor and that is all the court is going to look at!

In California it is illeagle for someone over 18 to have sex with someone under 18...but I kind of got the impression, that you are more just trying to get him into trouble, you are mad at him because he is mad at you, over his car. If that is true then that is NOT a reason to turn someone in for rape or child molesting. Those are not charges that you play with..you need to remember that it is a mans life you are talking about. IF he raped you or in any way forced you to do something that you did not want to do that is one thing BUT if he was your boyfriend and you had a fight and now you want to "get him good", that is wrong!

Since confusedbabe86 posted this nearly a year ago and has yet to return or post again, I'll throw my opinion in here.
I agree with rebel. Jealousy and retribution are no reason to take a consensual relationship and turn it into a crime. Based on her story, the crime was only a misdemeanor under California law anyway. But nobody told her that when she posted.

wow, you are right..I did not realize that this had been written so long ago! I am just a LITTLE behind...lol, but that is the story of my life.
As to your comment to my comment, I agree with you, in California it would have been a misdemeaner. Still if it was just for revenge on the guy..even a misdemeaner is wrong.
I am curious as to what she finally decided to do and what came of it. I hope that she did the right thing one way or the other.

I'm not a big fan of not reporting sexual abuse. Looking for reasons not to report such as, "It's just a misdemeanor", or that it is wrong to report a crime if it's for revenge is cowardly IMHO. When victims lack the courage or strength to report sex crimes they are silently accepting the abuse and allowing it to continue. Unfortunately, so many have been beaten down to this level, thus the cycle goes on and on.

I completely understand the family dynamic that goes on when the inner family circle is ill and why sex crimes often go unreported
My ex hubby (the one who passed away) has a family like that. His brother Mitch began molesting, humiliating and torturing his daughter when she was 8 and it lasted until she was 15. He had not had actual intercourse up to that point (when she turned 15). But, because she was getting her more relevant female body enhancements, she feared that this would be the next step. She struggled a very very long time with "telling" because she knew what would happen to her family, her sister, her mother and the humiliation of the trial since she was now in high school. She told her best friend what had been going on and she encouraged her to tell her mother. Her mom believed her without question (Deb is a wonderful mother but, like many, just couldn't see what was going on.....not sure if she suspected but she threw him out the very day her daughter spilled the beans so she was taken by surprise for sure). They went to the authorities and the investigation began.
Mitch fessed up and spent 7 years in jail. Anyway, at the trial, her paternal grandmother, after hearing Mitch's confession on the stand and his rationale for why it was acceptable.....went off on my niece and asked her how she could do such a horrible thing to her father....she asked her what type of girl she was....she basically blamed her for every single thing that happened during the abuse years. It makes me sick. I always suspected that my ex had been abused as a young boy but he would never fully admit to it nor speak about it. He held so much in and he drank and drugged like there was no tomorrow. Sadly, he was a super talented musician/singer who, tragically, never got well. He finally died in an alcohol related accident. His life, as a result of his homelife and abuse, was so tragic that it was difficult for me not to excuse his dysfunction after I got to really know his family.
When I blew the whistle on my ex for what happened to my daughter during a weekend visitation when she was three years old, I was cast out completely and the family has made absolutely no contact with us at all since. My daughter is now 16....but, I think it's a blessing in disguise that they've all stayed away....they are all so ill....every single one of them. I remember how difficult it was to blow that whilstle on my ex after witnessing what happened to my niece and how the family treated her. Deb finally moved away and didn't give her address to anyone. I spoke to her just before she left and she apologized for not disclosing where they were going but she didn't want to put me in the middle if anyone should come around asking about them. Now, I am out two nieces and a good friend I had in Deb. She just felt that disappearing was the safest bet for everyone concerned. I feel that void every single day....the holiday's are the worst.
