Hello deedeeotz. Welcome to this forum. I am very to hear about your 7 year old daughter. My oldest daughter is also 7. I understand exactly what you are saying. A 7 year old couln't possibly describe a sexual act in detail unless they were taught something by someone now could they?

Can you tell us about the new polygraph test? How valid is it and does it have a lot of credibility in the eyes of the Court? Is there any physical evidence?

Orolan, do you have any comments regarding the new polygraph? Would it be considered "junk science" along with the others? Would it be possible for someone to lie with no deception indicated?

Hi,

Sorry to here about your daughter. I hope she (and you) are seeing someone about it. As a rape victim myself as a child I know the parents often have feelings of guilt and need to get help (themselves) as well.

Can you tell us if this boy was charged / convicted or was this polygraph part of the procedure. How much credence is the prosecutor giving it?

the polygraph given was the voice activated all they did was place a microphone on his collar and asked yes and no questions. how could he pass. my 7yo daughter is not lying there is no physical evidence but she is traumatized by this i now have to take her to a child phsychitrist because counseling is not working she needs meds. i know the polygraph does not hold up in court. but the police in this town worship this polygraph. i cannot believe this teen passed this also my 14 yo son accually walked in on his little sister and his best friend messing around this is how i found out.. i have very little faith in the polygraph but the boys parents believe this polygraph and thinks that we are all making this story up. my son is haveing a hard time in school with kids telling him hes made this story up because his friend passed the polygraph. im not sure of what the test is called. if any one know more info about this polygraph or knows a similar situation with this polygraph please let me know. this horrible act has happened to my daughter 5-7 times. i am so sick over this she is so embarressed and depressed. and i cant help her. and now it looks like this boy is going to get away with this because of the polygraph.. please help thank you deedee

deedeeotz,
First let me say that I am very sorry. Raping a 7 year-old is inexcusable, and should be dealt with harshly.

What you speak of is CVSA, or Computer Voice Stress Analysis. It is pure garbage, and has even less credibility than the standard polygraph. Even the American Polygraph Association, bastions of support that they are for lie-detectors, say it is highly inaccurate.
Your best bet at this time is to hound the prosecutor's office day and night. The results of the CVSA are inadmissable in court unless the prosecutor and the boy's attorney agreed to it prior to the test. Find out what the agreement was. Is there other evidence besides your daughter's testimony? Results of a physical examination, verifiable contact between the two of them, etc?
You might want to visit antipolygraph.org and do a little reading up on the fallacies and inaccuracies of polygraphs so that you have some "knowledge" of the subject when talking with the prosecutor.

What exactly was "rape" in this case. If there was no physical evidence what exactly happend? (you dont have to get real specific but obviously this wasnt rape in the normal understanding).

If you want to learn more about how useless a polygraph is as a lie detector visit this webpage

It just about says it all.

I know this must really hurt you. I hope you focus on doing the right thing. The boy's parents are doing what they think is right which is supporting their son even if he did lie to them. He or the family may never admit any wrong doing. Win or loose it's important to get some type of closure so please stay strong. You are making memories for your daughter each and every day.

D,

Can you tell us if the polygraph was done as part of the court process or if the boys parents got it done independently? Will it or was it used in the court proceeding at all? How much faith is the prosecutor putting in the polygraph?
