Child to testify

Help- I live in Ohio and My son has been subpoened to testify next month as a witness. Can anyone tell me if he will be required to do this in open court or judge's chambers? The charge is Criminal Enticement of a Child. He is 11 years old.

If he has been ordered by the court he must appear , but he has a right to remain silent if he chooses to do so. But if he is the focus of complaint against another person it would be best that he does.I would suggest you check with the prosecutor and let him /her know that you do not want your child to testify and the reason for it. No one can be forced to say anything but if you are the one that bring the charges and fail to back them up I would be prepared for a lawsuit and possible criminal charges.

no actually we didnt file the charges- but my son is a material witness- I don't mind if he testifies- I just wondered how it would be handled.

Usually it will be in open court. Unless the judge closes the trial which is very unusual. He will probably have to speak in public.

If I can ask what is the nature of the charge? Was a friend of his enticed by someone for illegal activity? What happend?

He was outside playing when 2 other boys starting taking pictures of him with polaroids. He chased them down- or rather back to the man who gave the boys the cameras house- the man tried to get him to come inside- stroking his arm- telling him how pretty his eyes were- how cool his watch was- my son told him that he wasnt allowed in strangers' houses- the man told him that he knew me and it was ok- but my son asked him what my name was- he didnt know it- so my son grabbed some of the pictures and took off- he also tried to get the other 2 to leave- they wouldnt. He came home- told me what happened- and that the other boys were still there. We went to their houses and told their parents- who went to get theiir children- they were inside the house. Those parents called the police after what their children told them what occured. The police came to talk to my son and get the pictures he had grabbed of himself. Apparently there were pictures of the other 2 posed with their shirts off as well as 100s of other pictures of kids- including more of my son- from a distance.

The charge is a misdeam. inticement of a child- I had never heard of this. He is being called by the prosecutor.
