My friend was staying over at my apartment. she was downstairs on a couch while i was upstairs with my girlfriend. she was sleeping on the couch with my cat resting on her chest. my roommate came out, and started saying "hey kitty kitty" and proceeded to pet the cat. after petting the cat, he grabbed my friend's breast, at which point she said "that's not appropriate". after having said so, he pulled away, and said "i'm sorry" and went back to his room.
this is my friend's account of the story. i was wondering if this constitutes sexual assault?

Does your friend feel assaulted? I certainly would have. I don't know if it legally considered sexual assault. But, I believe it should be. Do we as a society want to tolerate that type of behavior? Of course, the guy will probably use the excuse that it was an accident. My ex-husband keeps saying that he accidently molested his step-daughter. The court obviously bought it. They gave him custody of our 6-yr-old daughter.

Reread the message again. Nowhere did it state that the guy was a "boyfriend" to the girl on the couch. Thus, it really was inappropriate of him to grab her breast. Her answer to him was all that was necessary to let him know that she did not accept his behavior.

I believe that this would be sexual assault, because your friend did not ask to be touched and she felt as if it was unwanted.
There for any touching or comments unwanted would be in my option it would be assault.

AHHH No It's not sexual assult. It's an immature stupid guy who was put in his place. When people start crying wolf over ever poor judgement call It only lessens the severity of Real sex offences. Therbye makeing life more difficelt for those of us with legetimate claims of sexual assult!!!

I have had many men touch my breasts when I didn't want them to. BOYS WILL BE BOYS! You can't go pressing charges on every man who walks on the earth. If I were a man I would be afraid of talking to woman in fear of being charged with sexual harrassment. Girls no longer hear the comments, because we have truely scared them away. He stopped as soon as she said something. End it there. Don't take it further. You press charges and he goes to jail and gets the modern 'scarlet letter'... doesn't erase what he has done, does it? Nope. What is his side.. Maybe he thought it was the cat and when confronted was quite embaressed, so left. :)
