I have a friend who was persued by a girl who kept telling him that she was 19. It turned out that she was an uncontollable teen and her mother could not maintain any control over the girl's activities. It also turned out that Fred had sex with the girl (at her insistance) and then the girl's mother decided to make Fred's life miserable by having him charged with rape.
Fred was convicted of Statutory Rape and was sentenced to prison [usually in Oregon this is not a criminal offense, but a misdemeanor]. He spent a year and a half in prison and then was forced to undergo "treatment" as a "child molester" by a local psychaitrist who billed him for each visit and ran up a bill of thousands of dollars. Fred tried to explain that he was not interested in children but that only made the psychaitrist extend the sessions for another six months.

I worked with Fred on a construction job site and saw this girl come out to the job site on many occasions looking for Fred and trying to catch up with him. She was the one who insisted that they have sex, too. Fred was a willing participant, but he was under the impression that the girl was 19, not 17.

Fred has spent his time in prison, and now is required to report his whereabouts to the police as a sex offender and is constantly harrassed by the local police and by the friends of the girl.

My main point is that not every case of sex is a forceful act and not every case is simply cut and dried. This time the victim is the guy who has paid his dues and then some. He was guilty of being stupid and of not being careful about what he believed to be true. He was a victim of a man hateing mother who could not control her daughter and decided to make an example of someone else. He wasn't framed, but he was not treated fairly. His name would be stuck on the same list as real perpetrators and he would be harrassed no end in this town. If he had been a 19 year old himself he would have had his wrists slapped and would not have had any prison time at all.

As in any case of law, there should be some form of justice in it's execution.
