The government can already punish you for speech. Consider the old standby test. You go to the theatre and halfway through the second act you yell out "FIRE". Such an act is not protected by free speech.
Consider this though. You're sitting in your living room. You think "You know, I ought to go to the theatre and yell 'FIRE' in the middle of the second act."
Should that be illegal?
Should it be 'less legal' if you happened to already have been convicted of doing such a thing? Or perhaps it's an OK thought, but if you did it before the government will ban you from theatres on the assumption that since you did it once, your only reason for going to a theatre is to do it again?
