Car stolen with baby boy inside
Police find the car with the child safe, and suspect a teenage girl stole the vehicle.

MARYSVILLE - A 3-month-old baby boy was found safe after a thief drove off in a car with him in it.
Police found the car outside a bowling alley in the 1000 block of Columbia Avenue at 6:10 p.m. Thursday, about 25 minutes after it was taken from the driveway of a home in the 800 block of Ash Avenue about a quarter-mile away, Marysville police Cmdr. Rob Lamoureux said.
The baby was not injured.
Police are searching for a teenage girl who witnesses saw driving the car, and police believe they know her identity. They used police dogs to track the girl, but the dogs lost her scent.
Apparently the boy's father parked in the driveway and ran into the house to get something. He left the motor running with the child still inside when the car was stolen according to the article. Should we make this girl register for kidnapping? After all it was just property crime and the baby just happened to be inside. It wasn't like she intentionally meant to kidnap the child.

Should we make this girl register for kidnapping? After all it was just property crime and the baby just happened to be inside. It wasn't like she intentionally meant to kidnap the child.
People have been charged and convicted of kidnapping during carjackings before. The only difference between this case is she's a teenage girl, not a male gang member or thug. You would not make this argument for leniency if she was a woman SO who molested the baby as opposed to a male SO, so why are you making it now?
In murder committed during the course of a felony, intent is not a element of the crime, only death during the commision of a felony has to be proved. The baby just happened to be inside, but intent isn't an element of kidnapping in this case. Only the outcome is relevant, the baby being stolen along with the car. Therefore, she's a kidnapper, and should be subject to kidnapping penalties, even if it means registration or a substantial prison sentence.
