i see that steve posted another article about this guy we have discussed in another thread. I found out some interesting info for you guys.

It seems that this guy was not aware of his requirement to register and no one ever told him until the fire at the house he owned but had moved from. Here is why.

He was convicted in 1995 for child molestation as a D felony for fondling. At the time of his conviction, his offense was not a registerable offense and he did not go to prison, but served less than a year in the county jail. Previous revisions in the law were not retroactive so he continued to not be required to register until the law changed in 2001 and was made retroactive back to the beginning of time. When this law was changed, his offense was added to the list of offenses in which an offender was required to register. Even then, no one ever told him of his requirement to register so he did not know until he was arrested on the firearms charge. Even now, a charge of FTR cannot be upheld because the law requiresa LEA to notify the offender of his requirement to register and give him sufficient time to do so. This was not done.
While conducting my research on our state's registry which I hope to eventually post one day, I found that there are several hundred offenders who are required to now register under the 2001 law, but since LEA doesnt know where they are, they have not been told of the requirement. So while the ISA claims that it isnt thier fault, it actually is. Compounded with the software flaws that were prevelant in the system, there are probably, at my best guess, over a thousand people who havent registered because they simply do not know that they are required to do so, and those who have lawfully registered but the ISA failed to re-enter that information into the registry after the software glitch that removed the correct info from the system. So tell me, who's fault IS that?
