He was arrested and convicted of willfully failing to update his registration, a felony, and sentenced to 90 days in jail, three years' probation and a $200 fine. The appeals court disagreed, saying Sorden had honestly forgotten and hadn't willfully broken the law. His conviction was overturned in October 2003.
But the state Supreme Court ruled 4-3 that forgetting is a valid excuse only when the sex offender suffers from a "most disabling" and "involuntary condition," like amnesia or Alzheimer's disease.
That's quite a stiff sentence for someone that actually registered on his own after realizing he was late. Why not find him guilty and give him time served? Can't the system reward criminals for attempting to correct a mistake in a responsible manner? I don't get it. The tough sentences should be for the people that willingly refused to register. What a waste of time.

and sadly this will cause others to not register at all. I mean if you are going to get the same sentence whether you register late or not at all why bother registering?

that is really unjustified to further bring this guy down at the lowest point in his life for a regulatory statute that he had faithfully complied with, save this situation. His conviction was 22 years ago! he has always met all requirements, and has not re-offended in all this time. The key phrase that the USSC will need to consider if it goes that far is the element of the act "willfully failing to update his registration" there is no way in hell that the prosecution can prove that he willfully failed to update his registration. Plain and simple, he forgot. He had complied for 18 years before and has complied in the 3 years since(SO have been required to register long before megans law in CA)
On a side note, The Bush lapdog neo-con judge recently appointed to a federal judicial post by Bush, Justice Janice Brown was the one who read the decision. So much for claims of compassionate conservatism. One can see why the democrats fought so hard to keep this woman from being appointed. She is the posterwoman for right wing radical religious fundamentalists and has shown she cant be objective or fair.
Lets face it, given the struggles he was enduring, he simply forgot, plain and simple. If I were going through all he had to contend with during that time, I wouldnt give a rat's behind about some BS registry either

Wow, I really think that if I, for whatever reason, ever forgot to register I would just keep going. I mean you get whacked one way or the other. Just make sure you don’t move and then move again because in Pennsylvania that would be two offenses and the minimum punishment is lifetime probation.

if that ever happens, let me know, you can move to the island. Wont be very much to do and no corner grocery, but what can most sex offenders do now in civilization anyway?

actually, there is one family of 6 and 4 others that have lived there since 1984 who have been the caretakers of the island thier whole life basically. very native folks who love to grow a certain budding crop. Im sure we will import women and children soon since they happen to come along with the families that went in on the purchase with me.
but in case you think i need women and children there, i hear there are plenty for sale on the human trafficking market, cheap.(just joking, id never do that)
we did make a pact that 50% of the island may never be developed, which is well and good, gives me more places to bury the bodies!
