that is really unjustified to further bring this guy down at the lowest point in his life for a regulatory statute that he had faithfully complied with, save this situation. His conviction was 22 years ago! he has always met all requirements, and has not re-offended in all this time. The key phrase that the USSC will need to consider if it goes that far is the element of the act "willfully failing to update his registration" there is no way in hell that the prosecution can prove that he willfully failed to update his registration. Plain and simple, he forgot. He had complied for 18 years before and has complied in the 3 years since(SO have been required to register long before megans law in CA)
On a side note, The Bush lapdog neo-con judge recently appointed to a federal judicial post by Bush, Justice Janice Brown was the one who read the decision. So much for claims of compassionate conservatism. One can see why the democrats fought so hard to keep this woman from being appointed. She is the posterwoman for right wing radical religious fundamentalists and has shown she cant be objective or fair.
Lets face it, given the struggles he was enduring, he simply forgot, plain and simple. If I were going through all he had to contend with during that time, I wouldnt give a rat's behind about some BS registry either
