Im not a big fan of civil commitment, but this case makes a good argument for it

I disagree. While he has issues, he's no sexual psychopath. The circumstances of his rape offense aren't very different than 90,000 other rapes annually, except for the age of his victim. Not minimizing his offense at all, but what about the other 89,999? Lock them up for life as well?
I don't like the fact he refused treatment, but without knowing the parameters of that treatment, we can't judge. No doubt the therapist is hounding him to admit that he likes to diddle 4 year-olds like all the rest of the "pedophiles" like him. Had I been in such a program, I would have been thrown out as well.

Orolan, you must be reading my mind. If one rape on a 14 year old is justification for civil committment then we need to start building more facilities because there's plenty other more dangerous RSOs out there. It seems like they are basing this on his bad attitude. If he was such a risk to the community then why did they even bother to release him to the community pending hearing? HELLO! Is this how we deal with dangerous people! These folks need some real experience with bad guys. This is their first case so I guess there's a learning curve. How long has the DA been out of law school?

I agree totally. So do you think some RSOs get treated more harshly because of the perception of "bad attitude" syndrome? I've seen it work both ways actually. I've seen where people that reoffend over and over get one break after another because they are always so sweet, polite and respectful; nevermind the damage done by all the crimes he committed. Female RSOs are a perfect example especially the attractive ones. We can't lock up a pretty lady now could we? All those little boys were begging for sex, right?

Anyone got a picture of this guy? Who wants to bet he's not pretty?

I think someone who is only out of prison one month and is already commiting a new felony needs to be committed if the state isnt going to put him in prison long enough to deter his crimes

You won't hear an argument from me about locking people up that commit crimes by putting them in jail or prison, but commit them as sexual psychopaths with one sex offense and an additional felony? Most of my caseload would be in a commitment center if that was the standard.

Didn't Orolan say he had a prior felony and a sex charge with a 14 year old? Hmmm.........maybe we could get away with committing him too if he's as ugly as this dude. Orolan, if you're good looking and your attitude stays in check you just might have a chance.

If there going to commit these guys as "mentally ill" then they should also have the right to use MENTAL ILLNESS as a defense in court and it SHOULD be a valid defense.

Think about it. They're basically saying these people can't control themselves and can't help what they did. Now where were these arguments at trial?

The law should say they can apply for civil commitment ONLY AT INITIAL TRIAL and in order to get it they MUST use the "mentally ill" argument. That means hospitalizing them from DAY ONE not prison then hospital.

you're right , silver. It is a big double standard. Is he, or is he not mentally unstable. they need to pick one and stick with it. Are these people getting "sick" while in prison? if so, then maybe we need to hold the state responsible? How far will this go? Will there come a day when a defendant is found not guilty, and the prosecuter still has him committed? Or will they simply decide a trial is not winnable, so they committ him instead, relying on a preponderance of evidence instead of reasonable doubt?
