A former judge was sentenced to 10 days in jail for having pleaded guilty to a sex offense.
James P. Kenney, 53, a former Hamilton County Municipal Court judge who also served as an assistant county prosecutor, pleaded guilty on Aug. 31 to a misdemeanor charge of sexual imposition. Kenney admitted that he inappropriately touched a 21-year-old man in February.

A special prosecutor has been appointed to investigate accusations that former Hamilton County Municipal Court Judge James P. Kenney inappropriately touched another man.
Kenney resigned Friday morning from his position as an assistant Hamilton County prosecuting attorney.

Even though he pleaded guilty, former judge and former prosecutor Jim Kenney shouldn't have to go to jail or register as a sex offender - as a judge has ruled - because the judge was being "vindictive" against a former colleague, Kenney's lawyer told an appeals court panel Wednesday.
"He's the one who put himself in the position," special prosecutor Andrew Sievers told the three judges from the Cincinnati-based Ohio First District Court of Appeals.
Kenney, Sievers said, is the one who unbuckled the pants and fondled the 21-year-old man Kenney victimized, to which Kenney pleaded guilty last fall to a charge of sexual imposition.
"This is a defendant who was an attorney, former judge and assistant prosecutor at the time ... and should have known these types of acts are offensive," Sievers said.

An appeals court upheld a jail sentence Thursday for a former Hamilton County prosecutor and municipal judge, but says he does not have to register as a sexually oriented offender.
Last year, James Kenney was sentenced to 10 days in jail, 2 years probation and labeled a sexually oriented offender who must register with police for 10 years.
