Looks like these people are blaming the wrong folks. The court said unless they are reclassified under the requirements of the court’s ruling.
“It’s my understanding that he has to be reclassified, and until then, law enforcement officials are prohibited from making public disclosure,”
So why didn't anybody reclassify him?
“This injunction defeats the purpose of Megan’s Law,”
No it doesn't. It merely requires that SO's classified pre-Megan's Law be reclassified post-Megan's Law.
This isn't rocket science. The Court issues an injunction in 1998, the guy gets out on parole in 1999 and released from parole 2 years later in 2001. The injunction was clear that if DOC wanted him classified at something higher than Level 1 they would have to re-classify him. And DOC did what during the time this man was on parole? Nothing.
And now DOC says it's the Court's fault? Get real. DOC dropped the ball and is looking for a scapegoat.

OK this guy is a scumbag and I hope he gets life.
But I still support that injunction. People sentenced before Megans law should be subject to the laws we had back then.
California last year tried to do away with the statute of limitations on sex abuse. They then tried and convicted hundreds of people for offenses 20-30 years ago. All those people were released when a federal court said you can't do that.
Same here. I don't believe retroactive laws like this are fair. It's like going up to a guy in prison and saying "oh by the way, instead of 10 years the law is now 30 years so we're giving you that".

Maybe some therapy would help the DOC to be able to own up to their behavior in this matter. It works pretty good on many of those prisoners they have authority over.

I don't believe retroactive laws like this are fair.
As I said elsewhere, the Constitution isn't worth the time, paper and ink it took to create it any more. "Fair" no longer matters, as long as it is "politically expedient".

As a mother, this hit too close too home. What about the innocent children? What about the parents, who try to do everything they can to protect their angels, from predators, like him? No, I didn't know about his past. I feel betrayed, sickened to my stomach, to know he was so close. We have a right to know, -regardless of what Megan's law was, back then. This is for the children we need to protect.

2busy4me, welcome to the site - I see you're new here. Since every state handles sex offender registration and community notification differently, it's all the more reason for parents to be vigilant and for people like you to make yourselves heard in these forums and elsewhere.
