Sex Crime
By Annalee Newitz, AlterNet. Posted March 18, 2003.
In the Feds' new child-porn crackdown, you can go to prison for five years for just visiting a child porn site by accident, through the magic of spam.
As I know from personal experience, it's very easy for a nonpedophile to get child porn images in her browser cache: Just visit a child porn site by accident, get weirded out, and leave. The images you glanced at in disgust remain in your cache like accusatory digital ghosts. There are also easy ways for a nonpedophiliac, porn-loving person like myself to find child porn images on her hard drive. If you want a bunch of sexy pictures, it's common to run one of many "spider" programs that are designed to browse newsgroups and automatically suck all images down to your hard drive for, erm, inspection later. If I'm looking for hot lesbian porn, I'll set my spidering software to download all of the images from the newsgroup alt.sex.lesbian. It's possible I may get one or two sick images from a jerk who posted them randomly. When I find those images later, I'll delete them. But even after deletion, the image files remain on my hard drive until the memory overwrites them. This may take years, or never happen. A forensic analyst could look at my hard drive, find those deleted images, and call me a pedophile.
Sure, there are ways for me to scour my hard drive and remove all traces of my deleted files: on Sourceforge there's a free software program for Windows called Eraser, and if you search for "wipe" there, you'll find a version of this program for Linux, too. But for people who don't know about these programs, there is always the danger that an image that crossed their desktop on the way to the trash or recycle bin can and will be used against them in court.

So how many innocent people will be railroaded posted and pilloried?.
How many already are?
The vicious and brutal nature of American prisons, bullies many into accepting a plea bargain ,when they might win their case.
In this case we may expect the witchunt to catch many innocent victims.
The odd thing here,is taht the verdict of a court,or appeal court,as to what is,or is not Child pornography, can put thousands in or out of the definition of "SEX OFFENDER"(tihe definition of this varies from atate to state, what someone is posted and pilloried for in one state, the address where they live with their Children,is legal across the road in the next state)and "PAEDOPHILE"(it is possible within the United States,to abuse a 17 year old Child,or have consensual sex with 16 year old adult for precisely the same act, some states have a "Romeo and Juliet" law, whereby the DIFFERENCE in ages counts, others don't and tw0 15/16/17 year olds, having consensual sex are both posted and pilloried on the registry,as having "RAPED!!!" each other ,some, alone in western society have have legal Child "marriage",and an old roue or paedophile can buy himself a Child bride, others thankfully don't,Mark Klaas has said "never in history has a paedophile been cured",in fact they must be "cured" all the time ,simply by crossing state lines.)(*1 NOTE).
Is there a national definition of "Child pornography"?(there isn't an international one.pictures of naked boys are considered traditional art in Germany,Victorian art is full of pictures of naked Children, these must have sometimes been posed, that wouldn't be allowed now).
Or does it change with the state consent age with an item or picture ,becoming/ceasing to be,Child pornography as it crosses state lines?
(*1 NOTE)Of course none of this makes anything right.People, including Romeo and Juliet's,should keep the law where they are.

What's this lady smoking? It's impossible for a person to have kiddie porn on their computer unless they purposely downloaded it. Don't we have a poster here who gets slammed on a regular basis for claiming the traces of porn found on his borrowed laptop weren't purposely downloaded by him?
Next thing you know people will want him barred from working at Chik-Fil-A.

There are national statuets against child pornography :
18 USC 2252
http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00002252----000-.html
18 USC 2251
http://www4.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00002251
Also do a search on New York vs. Ferber it addresses the state issue
