Illinois will fine spammers who sneak in ads, porn

Illinois strengthened its anti-spam law in July when Gov. Rod Blagojevich signed a bill requiring labels to appear in the subject line on advertising and pornographic e-mails.
Under the law, which goes into effect Jan. 1, e-mail must be labeled "ADV:" for advertising and "ADV:ADLT," for pornographic material. Fines will range from $10 for each offense to as much as $25,000 a day.
Rep. Kevin Joyce (D-Chicago), who sponsored the legislation, says he won't push for a "do not spam" registry in Illinois, at least not yet.
"I think we need to get through the do-not-call list first," Joyce said. "The Internet laws are still questionable constitutionally because we've never dealt with them before because the Internet's so new. What we've done in Illinois is a start."
Before the amendment passed in July, Illinois law made it illegal to send spam with false subject lines or routing information. Sorkin wasn't certain, but he doubted if the law had been enforced.
It may all be moot. According to a spokeswoman for Sen. Conrad Burns (R-Mont.), the national bill passed in the Senate on Wednesday, which was sponsored by Burns, would supercede anti-spam laws on state books.

I wish this country would put porn spam laws into action. I am sick of the filth coming into my email. As a " not too young spring chicken" and female to boot, I do not need pills to enhance anything on my body . Everybody and their relatives seem to have access to Viagra.I thought these things were only accessible through prescription. Any one buying it over the internet is taking a chance. How do you know what it contains.

This like the sex offender register is just a knee-jerk action by politicians to gain public recognition. Most people turn in spam complaints to their ISP who in turn send these impossible requests to the 'recycle bin' on their computers.
The current laws aren't enforced as stated and the new ones won't be either. I suspect the only time you will ever see them enforced is in conjunction with other offenses. This is common for these type of laws.
For example in some states it is considered 'an act against nature' to engage in oral sex. You would never find vice cops charging couples with this law however you will see it used quite often when busting a prostitute. Just another charge to throw at someone who has broken a more severe law.

Anti-spam laws either have no teeth or they try to bite the wrong person. Now if they pass a law saying that the MAKERS of Viagra have to pay $20 per spam message about their product to the recipients, you can BET that they will find a way to prevent people from trying to sell it online. Ditto credit cards, herbal medicines, mortgages, cell phones, Mathew Lesko, ad infinitum.
With the exception of porn sites, every spam message involves trying to sell you something. Somebody "makes" that something, and the monkey should be put on their back to insure that the products are being marketed in a fair and non-invasive manner. After all, they ARE the ones making money off the products.

Heres an interesting idea. Suppose we put these PORN SPAM people on the registry? I mean we all know kids end up seeing this stuff by accident. Now isn't it true if I show Billy a playboy magazine thats a sex crime? Why isn't it the same here?
These purveyors of porn when caught not protecting who their stuff is sent to should be registered as well.

Good idea, but no ability to do it. Typically you can't actually identify the spammer because they've bounced through so many servers that by the time you backtrack all the way, they've moved on. And site owners are just as bad. Maybe the government should start paying hackers to shut down porn sites? They could justify this illegal activity under their favorite "compelling interest" excuse.
