Illinois will fine spammers who sneak in ads, porn

Illinois strengthened its anti-spam law in July when Gov. Rod Blagojevich signed a bill requiring labels to appear in the subject line on advertising and pornographic e-mails.

Under the law, which goes into effect Jan. 1, e-mail must be labeled "ADV:" for advertising and "ADV:ADLT," for pornographic material. Fines will range from $10 for each offense to as much as $25,000 a day.

Rep. Kevin Joyce (D-Chicago), who sponsored the legislation, says he won't push for a "do not spam" registry in Illinois, at least not yet.

"I think we need to get through the do-not-call list first," Joyce said. "The Internet laws are still questionable constitutionally because we've never dealt with them before because the Internet's so new. What we've done in Illinois is a start."

Before the amendment passed in July, Illinois law made it illegal to send spam with false subject lines or routing information. Sorkin wasn't certain, but he doubted if the law had been enforced.

It may all be moot. According to a spokeswoman for Sen. Conrad Burns (R-Mont.), the national bill passed in the Senate on Wednesday, which was sponsored by Burns, would supercede anti-spam laws on state books.
