If the activity took place in your home state, then it sounds as though the sexual activity b/w your brother and the girl was legal. Though if that wasn't his home state and one or both crossed state lines to have sex then it may have been illegal. At this stage I suppose it's not really relevant since what's done is done and your situation is due to a conviction that was unrelated to whether they had sex or not.

I'm giving you the benefit of the doubt on the information you shared because I have no reason not to. I'm also not a lawyer. Based on the information you provided I think it was a lapse of judgment to ask her if she enjoyed the sex with your brother and given the context of the conversation you had with them I am not convinced that you should have been prosecuted. At worst I think you should have received a suspended sentence and should have been required to apologize to the girl and her parents. I don't see the need for you register as an offender since I believe the value of the registry and community notification is diluted if people like you who probably pose little threat are required to register.

Again, my opinions are based on what you've shared. I'm not surprised if some readers here question your story, especially since some of the decisions you made are different than what many of us probably think we would have done in the same situation, but unless you or another poster gives me a reason not to believe what they're saying, I give them the benefif of the doubt.
